No it Isn’t…Yes it is. No it Isn’t…Yes it is.

Marijuana is the subject of much debate all over the nation.  In Ohio the law is very emphatic…no it isn’t legal!  Those that favor the use of marijuana for various reasons say “it’s no big deal for heaven’s sake…it’s just weed.  There are still judges in the Buckeye State who treat weed the same way they view hard drugs.

Help…Not Jail.

Drug offenders struggling with substance abuse or dependence need help, not jail!  It is a statement that has been shouted all over the U.S. and Northeast Ohio is NO exception.  Instead of incarceration, for people charged with drug possession offenses or drug-related probation and parole violations there is community-based treatment.

Latinos and Blacks are particularly harder effected by the tendency to just “throw the offender in jail” rather than seek treatment.  There are various resources to seek out in the Akron area.  My goodness, you can even wear t-shirts that show your support for humane drug treatment throughout Northeast Ohio.

Jury vs. Bench…That is the Question.

The choice between a jury or bench trial is an important one.  You need a top-flight criminal defense attorney who understands the important advantages and disadvantages of both.  There is so much stress if you have been accused of a major crime in the State of Ohio.  The family is probably not thinking rationally.  You need to retain someone who is!

Some might prefer bench trials if they have a particularly complicated case that they believe may confuse a jury.  Bench trials tend to have outcomes more favorable to professionals.  For the plaintiff a jury trial might be preferable.  Judges often have a firmer grasp on “the burden of proof” than 12 diverse individuals.

The Romeo and Juliet Law in Ohio.

Where fore art thou?  This is not about where, but rather what.  What is the Romeo and Juliet Law?  Very simply, it is designed to prevent the prosecution of underage couples who engage in consensual sex when both participants are very close in age to each other, but one or both are below the age of consent.

So, what is the age of consent in the State of Ohio?  It is currently 16.  Someone who has passed their 16th birthday can consent to have sex with another individual no matter what their age difference is.  Now here is an interesting caveat… Ohio's age of consent law currently only applies to heterosexual encounters.

The Latest Weed Laws in Ohio.

Recreational use of marijuana remains illegal in Ohio.  The state does allow the medical use of weed.  House Bill 523, which took effect back in 2016, established the structure for medical marijuana in the state.  While there are no dispensaries set up, eligible patients my obtain a state-issued patient identification card to use as an effective defense.

Like most states, Ohio has substantially loosened its marijuana laws.  Possessing less than three and a half ounces of cannabis is considered a minor misdemeanor according to Buckeye State law.  However, you could have your driver’s license suspended for up to five years!  That last point may have gotten your attention.

April 19, 2017…An Important Date in Ohio Legislative History.

Why this date?  What is significant about that date?  It was the date that “Annie’s Law” became effective.  It brought important changes to Ohio’s drunk driving statutes.  Under Ohio law, drunk driving is referred to as Operating a Motor Vehicle While Intoxicated, or more commonly known as OVI. 

Under Annie’s Law, the “look-back” period is now 10 years instead of the previous 6.  For drivers who are convicted of a second OVI within 10 years of their first, this means that their punishment is now greatly enhanced.  Also, inherent in “Annie’s Law” is its major emphasis on the use of ignition interlock devices.
