Marijuana Possession in Ohio.

There is a state initiative on the 2023 ballot to legalize possession (in certain amounts) AND use for Ohioans over 21. There is one huge problem…it won’t be on the ballot until November of this year! The Latest Weed Laws in Ohio.

Recreational use of marijuana remains illegal in Ohio.  The state does allow the medical use of weed.  House Bill 523, which took effect back in 2016, established the structure for medical marijuana in the state.  While there are no dispensaries set up, eligible patients my obtain a state-issued patient identification card to use as an effective defense.

Like most states, Ohio has substantially loosened its marijuana laws.  Possessing less than three and a half ounces of cannabis is considered a minor misdemeanor according to Buckeye State law.  However, you could have your driver’s license suspended for up to five years!  That last point may have gotten your attention.

Ohio’s Current Marijuana Laws.

Attorney General Jeff Sessions recently caused quite a stir when he seemed to be indicating that he is on a national crusade against the use of marijuana throughout the country.  Just when you thought weed was soon to go the way of the cigarette when it comes to law enforcement, there is a chance it could be going the other way.

A medical marijuana law was passed way back in May of 2016.  Details such as who will grow and sell marijuana and how much patients can buy, were left to the Ohio Department of Commerce, Ohio State Board of Pharmacy and Ohio State Medical Board.  Patients must be registered by physicians with whom they have a relationship.

No Wakie Bakie.

Sorry, Ohioans you have not come around just yet to the notion that marijuana should be treated like alcohol.  Whether we like it or not this controversial “drug” is still illegal in the Buckeye State and will be for the foreseeable future.  Ohio is a state where NO ONE can ever say…it’s no big deal it’s just weed.

Prosecutors have a penchant for treating recreational marijuana users the same way that they treat hard drug defendants.  It may seem archaic, but that is the way it is.  By the way, medical use of weed was approved by the state on Sept. 8, 2016.  Another piece of good news is that Ohio has loosened its marijuana laws in general.

Drug Penalties in Ohio.

It’s a brand new year and we just made it through another holiday season.  We don’t want to start out 2017 with some scare tactic, but we do want you to be aware of the consequences of drug possession and trafficking in the Buckeye State.  Penalties may be severe including large fines and YEARS, not months of prison for certain convictions.

Marijuana and The Election.

We are all looking at the 2016 election as one of the most impactful of all time.  Besides the obvious, the decisions that were made about the future of marijuana use in this country were ground-breaking.  Some states legalized its recreational use while others made it available with a doctor’s note.  Whatever the case we are getting closer and closer to the legalization of this controversial drug.

Marijuana has different effects on individuals.  Some people may lose their focus and others report a heightened awareness of their senses.  Did you know that there are more than 400 chemicals in the average marijuana plant?  When it is smoked the heat from that procedure produces even more of them!  This is not meant to scare you, but to remind you that Ohio has not made marijuana use legal…yet.
