Too Many Holiday Parties?

Physical Control.

This is not a football term that applies to Baker Mayfield of the Cleveland Browns.  I know that we admire his steely-eyed coolness in the pocket, but in this case, it deals with being in a vehicle while under the influence of alcohol or drugs with one exception…physical control does not require that the vehicle have ever been driven or even started.

Here is a good example…you stagger out of the tavern and decide to “sleep it off” in your vehicle.  Maybe you decided to start the car, either to run the air conditioner or the heater, so the vehicle is actually running, then you drift off.  But make no mistake about it, you don’t even need to have the car running or even have the keys in the ignition in order to be in violation.

April 19, 2017…An Important Date in Ohio Legislative History.

Why this date?  What is significant about that date?  It was the date that “Annie’s Law” became effective.  It brought important changes to Ohio’s drunk driving statutes.  Under Ohio law, drunk driving is referred to as Operating a Motor Vehicle While Intoxicated, or more commonly known as OVI. 

Under Annie’s Law, the “look-back” period is now 10 years instead of the previous 6.  For drivers who are convicted of a second OVI within 10 years of their first, this means that their punishment is now greatly enhanced.  Also, inherent in “Annie’s Law” is its major emphasis on the use of ignition interlock devices.
