Jury vs. Bench…That is the Question.

The Romeo and Juliet Law in Ohio.

Where fore art thou?  This is not about where, but rather what.  What is the Romeo and Juliet Law?  Very simply, it is designed to prevent the prosecution of underage couples who engage in consensual sex when both participants are very close in age to each other, but one or both are below the age of consent.

So, what is the age of consent in the State of Ohio?  It is currently 16.  Someone who has passed their 16th birthday can consent to have sex with another individual no matter what their age difference is.  Now here is an interesting caveat… Ohio's age of consent law currently only applies to heterosexual encounters.

The Latest Weed Laws in Ohio.

Recreational use of marijuana remains illegal in Ohio.  The state does allow the medical use of weed.  House Bill 523, which took effect back in 2016, established the structure for medical marijuana in the state.  While there are no dispensaries set up, eligible patients my obtain a state-issued patient identification card to use as an effective defense.

Like most states, Ohio has substantially loosened its marijuana laws.  Possessing less than three and a half ounces of cannabis is considered a minor misdemeanor according to Buckeye State law.  However, you could have your driver’s license suspended for up to five years!  That last point may have gotten your attention.

April 19, 2017…An Important Date in Ohio Legislative History.

Why this date?  What is significant about that date?  It was the date that “Annie’s Law” became effective.  It brought important changes to Ohio’s drunk driving statutes.  Under Ohio law, drunk driving is referred to as Operating a Motor Vehicle While Intoxicated, or more commonly known as OVI. 

Under Annie’s Law, the “look-back” period is now 10 years instead of the previous 6.  For drivers who are convicted of a second OVI within 10 years of their first, this means that their punishment is now greatly enhanced.  Also, inherent in “Annie’s Law” is its major emphasis on the use of ignition interlock devices.

The Drug and Criminal Justice Policies Initiative.

This is just one of the many hundreds of issues that appeared on state-wide ballots last November.  We all know that The House is now controlled by the Democrats and The Senate by the Republicans, but what about this Drug and Criminal Justice Policies Initiative on the Ohio ballot?  Well, it was defeated.

By voting no, Ohioans essentially –


1.  Did not reduce most drug possessions to misdemeanors.
2.  People on probation can still be sent to prison for non-criminal violations.
3.  Did NOT create a sentence “credits” program for participation in rehabilitation.
