Drunk Driving in Ohio…What to Expect.

More than 20,000 people were killed in alcohol-impaired driving crashes, accounting for nearly one-third of all traffic-related deaths in the U.S. in the latest reporting period.  That is according to the Centers for Disease Control and Prevention, but this has declined over the last three decades as laws have gotten tougher and tougher.

On average, first-time offenders should expect to spend a minimum of one day in jail, while those who are convicted of their second offense should anticipate at least 21 days in prison if found guilty.  The State of Ohio takes all drunk driving very seriously, beginning with the first offense. If you’re convicted you may face a variety of administrative and criminal penalties, including but not limited to fines, a suspended or revoked license, and vehicle impoundment.  .

OVI vs. DUI.

You may have heard of both acronyms if you live in the Buckeye State.  What is the difference between OVI and DUI in Ohio?  The short answer is nothing.  DUI, of course stands for driving under the influence.  OVI is just a different way of expressing it.  It simply means operating a vehicle while the driver was under the influence of alcohol or drugs.

Just a reminder… you can be arrested for an OVI if you are found to have a blood alcohol content of 0.08 percent or higher.  Of course, that is where the Russian Roulette of it all comes into play.  How do you reach that limit?  Are you a five-foot-two 115 pound woman or a six-foot-three 210 pound man?  Alcohol consumption affects us all in a different way.

Here is the bottom line.  If you plead or are found guilty of an OVI or a DUI (a rose by any other name) for the first time, you will be jailed for a minimum of 3 days or up to 6 months and you can be fined up to $1,000!  The only sin you may have committed is not calling Jon Sinn.  He is an Akron Ohio drunk driving defense attorney.  Call him immediately at (330) 431-0160.

What is Your Capacity?

Have you ever seriously considered what it takes to be over the legal limit of alcohol?  We may know when we have “had too many”, but is it possible to stop at or near the brink?  It might be, but so many factors figure into that.  For instance, a man of approximately 160 pounds SHOULD be able to consume three beers in an hour and barely be under the legal limit.

Now the factors…body weight, gender, tolerance, the type of alcohol that you consume.  Three shots may not equal three beers and you need to be acutely aware of that before you put the keys in the ignition.  Here is another little tidbit.  You may blow a 0.05 and be under the limit, but if you are driving carelessly you will still get pulled over and ticketed!

OVI, DWI, DUI.

These are three acronyms with which we don’t want to be faced.  In the State of Ohio you should at least be familiar with them.  When it gets right down to it we are saying the same thing when describing these three driving offenses.  It means someone has been arrested for operating their vehicle while under the influence of alcohol or drugs.

Here are some of the extenuating circumstances with which you need to be aware –

1.  You may have difficulty keeping your current employment.
2.  This goes hand-in-hand with #1, but you may find it very difficult to get another job.
3.  Maintaining your license to drive a “company vehicle” may become challenging.
4.  Possible denial of immigration proceedings…a hot button issue these days.

A DWI is Still a DWI.

Some people are living in an unreal world.  They actually think that if they are arrested for a DWI in the state of Ohio that the severity of the charge will be lessened if they are operating a motorcycle or scooter.  Nothing could be further from the truth.  You could be driving a lawn mower, a tractor, even a golf cart and it is still considered a “motor vehicle”.

Just because the accused does not feel that he or she could have done much damage, serious legal problems may still follow a DWI arrest.  Just using the motorcycle as an example you may be operating the smallest vehicle on the highway.  If you are the one who was deemed to have been driving impaired that much larger car is not at fault…you are.
