The Drug and Criminal Justice Policies Initiative.

This is just one of the many hundreds of issues that appeared on state-wide ballots last November.  We all know that The House is now controlled by the Democrats and The Senate by the Republicans, but what about this Drug and Criminal Justice Policies Initiative on the Ohio ballot?  Well, it was defeated.

By voting no, Ohioans essentially –


1.  Did not reduce most drug possessions to misdemeanors.
2.  People on probation can still be sent to prison for non-criminal violations.
3.  Did NOT create a sentence “credits” program for participation in rehabilitation.

The History of Criminal Justice.

So, how did we get to where we are today?  Law enforcement in ancient China was administered by “prefects”.  Under the rule of Dang Lin Wang a new judicial system began to emerge.  Prefects usually reported to the local magistrate, just as modern police report to judges.  Prefects were responsible for handling investigations, much like modern police detectives.

In ancient Rome and Greece duties associated with modern police enforcement were done by private citizens.  The Roman Empire somehow managed to maintain civil order until its fall.  Believe it or not, the city of Rome never had an actual police force!  By the reign of Augustus Rome had a population of over one million citizens.

Criminal Trial 101.

We hope that you or a loved one never has to be faced with a criminal trial in Ohio or any other state for that matter.  Just in case one ever haunts your family we want you to understand the basics.  Depending on the circumstances, you may receive a summons, an appearance notice, etc.  No matter what document it happens to be, make sure that you hang on to it.

Soon, the prosecutors must give you a copy of all of the charges against you.  This is known as “disclosure”.  They must disclose police reports, witness statements, a history of your personal criminal record, and any statements you may have already made.  Here is an important lesson.  Call an attorney BEFORE you incriminate yourself!
