OVI, DWI, DUI.

These are three acronyms with which we don’t want to be faced.  In the State of Ohio you should at least be familiar with them.  When it gets right down to it we are saying the same thing when describing these three driving offenses.  It means someone has been arrested for operating their vehicle while under the influence of alcohol or drugs.

Here are some of the extenuating circumstances with which you need to be aware –

1.  You may have difficulty keeping your current employment.
2.  This goes hand-in-hand with #1, but you may find it very difficult to get another job.
3.  Maintaining your license to drive a “company vehicle” may become challenging.
4.  Possible denial of immigration proceedings…a hot button issue these days.

Remember this one?

Several years ago a man by the name of Vernon Singleton was in the news in Northeast Ohio.  He had been accused of the murder in the shooting death of an 11-year old in Akron back in August of 2011.  Twenty-six year old Vernon Singleton was arrested and charged with the girl’s murder.

Just days before the trial was to begin in July of 2012 Mr. Singleton was release from the Summit County jail.  Just like so many other young men he was already tried in the court of public opinion.  In this case, the charges were dismissed without prejudice and Vernon walked away from the situation a free man.

What is Judicial Release?

Let us start with a definition.  Hopefully, you don’t have to ever become familiar with this term, but if you do you will definitely need to understand it fully.  This phrase pertains to the release of a felon BEFORE their term of incarceration has ended.  Of course, it is not “get out of jail free”, but it is a way to get back into society with certain restrictions.

How do you apply for judicial release in Ohio?  It is important to begin the process as quickly as possible because it may take two or three months to complete.  Let me direct you to Ohio revised code Section 2929.20.  And remember, before you get too anxious…not all crimes in the Buckeye State are eligible for this form of early release.

Ohio’s New Laws for Motorists.

We are a quarter of the way through 2017 and you probably are not aware that the Ohio legislature enacted dozens of new laws that took effect on January 1st.  Some of them may very well have an impact on you and you need to be aware of them.  This is especially true if you get pulled over one of these days for an offense you didn’t even know existed!

Did you know that Ohio motorists must give cyclists a minimum of three feet of clearance when passing?  Also, beginning in 2017 you can actually go through a stop light if it malfunctions and does not detect your vehicle coming to a stop.  If, heaven forbid, someone is killed with a car the driver’s license will be suspended AFTER they get out of prison instead of during their sentence.
